Terms of Sale

These terms apply when you buy goods from VALORA. They do not remove any right that cannot lawfully be excluded, including the consumer guarantees under the Australian Consumer Law.

1. About these terms

These Terms of Sale apply when you buy goods from VALORA PACIFIC PTY LTD (ABN 81 698 730 031), trading as VALORA (we, us or VALORA), through this website.

These terms apply to retail and trade purchases. A business purchaser may also be a “consumer” under the Australian Consumer Law, including where the statutory price or use tests are met. Nothing in these terms removes rights that cannot lawfully be excluded.

Separate terms may apply to membership points, rewards, referrals, trade accounts and painter introductions. If separate terms conflict with these Terms of Sale, the provision that gives effect to a mandatory legal right continues to apply.

2. When you accept these terms

Before you submit an order, checkout asks you to confirm that you have read and agree to these Terms of Sale and acknowledge our Privacy Policy. The box is not ticked for you, and an order cannot be created and no payment can be started until you tick it — this is checked on our servers, not only in your browser.

We record the version of these terms you accepted, the time you accepted it and the language of the page you accepted it on, against your order. The version that applies to your order is shown on your order confirmation email. The version currently published is 2026-08-11.

That confirmation is about the terms of the sale only. It is not consent to marketing, and it is not consent to any sale of your personal information — we do not sell personal information.

3. Product information

We take reasonable care to describe products accurately. Product images and colours shown on a screen are a guide and may be affected by lighting, display settings and the surface to which paint is applied. Read the current product label, Product Data Sheet and Safety Data Sheet before use, and follow preparation, application, storage and safety instructions.

Tell us before ordering if you need a product for a particular purpose and want us to consider that purpose. Nothing in this section limits a consumer guarantee, including that goods be of acceptable quality, match their description and be reasonably fit for a disclosed purpose.

Product availability and stock can change. We will not knowingly accept payment for goods we do not intend, or know we will be unable, to supply.

4. Prices, GST and payment

We may correct a genuine pricing or description error before accepting an order. If you have already paid and we cannot lawfully or reasonably fulfil the order at the confirmed price, we will contact you and provide an appropriate solution, including a full refund if the order is cancelled. We will not increase an accepted order price without your agreement.

  • Prices are in Australian dollars and include GST where GST applies.
  • The price that applies is the price displayed at checkout when you submit the order, together with any delivery charge or discount shown there.
  • Unavoidable charges are included or disclosed before you commit to the purchase. Any payment surcharge, if introduced, will be disclosed before payment and will not exceed the amount permitted by law.
  • Card payments are processed by Stripe and PayPal payments by PayPal. VALORA does not store your card number.
  • Bank transfer may be available. An order paid by bank transfer will not be released until cleared funds are received.

5. Placing and accepting an order

Submitting an order is an offer to buy the goods on these terms. An automated receipt or payment authorisation confirms that we received the request; it does not by itself require us to supply goods that are unavailable or affected by a genuine error.

A contract is formed when we send confirmation that the order has been accepted. For bank transfer, acceptance and fulfilment remain subject to cleared funds. We may contact you to verify information, arrange freight or resolve availability before dispatch.

If we cannot supply an accepted order within the promised time or, where no time was promised, within a reasonable time, we will tell you and offer a reasonable solution. Depending on the circumstances, this may include a replacement, a revised delivery arrangement, or cancellation and refund.

6. Delivery and Click & Collect

The delivery option and amount shown and accepted at checkout form part of the order. Current delivery structure:

  • Brisbane Metro: orders of A$280 or more qualify for free delivery. Below A$280, checkout may offer paid local delivery where a supported rate is configured, or free Brisbane Click & Collect.
  • Sydney, Melbourne and Adelaide Metro: orders of A$1,000 or more qualify for free delivery. Below A$1,000, checkout may apply a supported delivery rate or refer the order for a manual freight quote.
  • Other Australian destinations: freight is quoted manually. Product charges and freight may be confirmed separately. We will not dispatch until you accept and pay an applicable freight quote.
  • Brisbane Click & Collect: free. The private pickup location and collection instructions are provided after order confirmation.

6a. Delivery dates, risk and title

Thresholds and prospective delivery rates may change. The amount displayed and accepted for your order will not be changed afterwards without your agreement.

Delivery dates are estimates unless we expressly agree to a guaranteed date. We will give clear information about a known delay and work with you on a reasonable solution. Please provide a complete and accurate delivery address and safe access details. If an avoidable re-delivery is needed because the supplied information was materially wrong, or because nobody was available under an agreed delivery arrangement, we may ask you to agree to the reasonable re-delivery cost before trying again.

Risk in the goods passes to you when the goods are delivered to the agreed location or collected by you or your authorised representative. Ownership passes when we have received full payment.

For Click & Collect, bring the order confirmation and reasonable identification. If another person will collect, tell us first where practicable.

7. Cancellations and change of mind

Contact us promptly if you want to change or cancel an order. We will try to help before dispatch or collection preparation, but cannot promise a cancellation once fulfilment has begun.

VALORA does not accept returns solely because you changed your mind, found a lower price elsewhere, ordered too much, or no longer want the goods. Please check product, colour and quantity before ordering.

This change-of-mind position does not apply where goods fail to meet a consumer guarantee, are faulty, unsafe, materially different from their description or sample, or where another right applies by law. Opening a container, or using enough product to discover a problem, does not remove those statutory rights.

8. Australian Consumer Law rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

For a major problem with goods, you may generally choose a refund or replacement. For a minor problem, VALORA may choose an available lawful remedy, such as repair, replacement or refund. Other remedies and compensation may be available where the law provides them.

We do not impose a fixed number of days on a claim made under the Australian Consumer Law. How long the guarantees last depends on the nature of the goods and what is reasonable in the circumstances.

8a. VALORA does not currently offer a voluntary manufacturer's guarantee

VALORA does not currently offer or advertise any voluntary manufacturer's guarantee in addition to the consumer guarantees above, and no VALORA pail, label or packaging carries one.

This does not reduce your rights in any way. The consumer guarantees described in section 8 are set by statute, apply to everything we sell you, and cannot be excluded, restricted or modified — with or without a voluntary guarantee sitting on top of them.

9. Reporting a problem, returns and refunds

If you believe something is wrong with a product, report it at /support/product-issue, or contact us at valorapacific8@gmail.com or 0426 895 676 with your order number and a description of the issue. We may request reasonable evidence or assess the goods before providing a remedy. Proof of purchase can take forms other than the original receipt.

Do not send heavy paint containers back without first arranging the return with us. Where VALORA is responsible under the Australian Consumer Law for collecting goods that are large, heavy or difficult to return, we will arrange collection or pay the reasonable transport cost. If you reasonably pay return costs and the product is confirmed to have a problem, we will reimburse reasonable costs on evidence such as a receipt.

Where a refund is required, it will ordinarily be returned to the original payment method where practicable. We will initiate it within a reasonable time after entitlement is confirmed. Banks, Stripe or PayPal may take additional processing time outside our control.

We do not charge a restocking or assessment fee for a valid consumer-guarantee remedy. If an assessment reasonably establishes that there is no product problem and the claim is not otherwise covered, we may ask you to pay reasonable collection or inspection costs that were explained to you in advance, where the law permits.

10. Accounts, trade pricing and promotions

You are responsible for keeping account credentials secure and for information submitted through your account. Tell us promptly about suspected unauthorised use.

Trade prices, rewards, points, referrals and promotions may have separate eligibility and program terms. A discount or benefit applies only when the checkout confirms it. We may correct fraud, duplicate credits or obvious administrative errors, but will not use a unilateral change to remove a benefit already earned where doing so would be unfair or unlawful.

11. Painter introductions and third-party services

Painter introductions are currently unavailable. VALORA is not arranging introductions, accepting painter applications or publishing a painter directory, and is not passing customer contact details to any painter. The rest of this section governs any introduction made while the feature was available, and will apply again if it returns.

VALORA's painter-introduction feature is separate from the sale of paint. Unless a transaction expressly states otherwise, an introduced painter is an independent supplier of painting services and VALORA is not the contracting painter. The painter is responsible for their quote, their contract and their work.

VALORA does not independently verify a painter's licence or insurance. Those details are self-declared by the painter. You should ask for and check them yourself before you engage anyone.

This section does not exclude any duty or consumer guarantee that applies to a service VALORA itself supplies, and it does not permit misleading statements about a painter's status, licence, insurance or work.

12. Liability

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the extent the law permits, VALORA is not responsible for loss that was not reasonably foreseeable, was caused by your misuse contrary to product instructions, or was caused solely by an independent third party for whom VALORA is not legally responsible. This section does not affect liability for VALORA's own misleading conduct, negligence, breach of contract or failure to meet a consumer guarantee where liability cannot lawfully be excluded.

13. Privacy

Our Privacy Policy explains how we handle personal information. Order and account information is handled in accordance with that policy and applicable law.

14. Changes to these terms

The version of these terms accepted when an order is placed applies to that order. We may update these terms prospectively by publishing a new version and effective date. We will not retrospectively change an accepted order or remove an accrued mandatory right.

15. Governing law and complaints

These terms are governed by the laws of Queensland and the Commonwealth of Australia. Courts with jurisdiction may hear disputes. Nothing in this clause prevents a consumer from using a forum or right available under applicable law.
